WHAT IS PROBATE?

WHEN IS PROBATE REQUIRED?

WHAT IS ESTATE ADMINISTRATION?
Estate administration is the wider responsibility of managing a person’s financial and legal affairs after their death. This includes:
- Applying for a Grant of Probate (if there is a will) or Letters of Administration (if there is no will)
- Gathering and securing assets
- Settling debts and taxes
- Distributing the estate to the rightful heirs
An executor (named in a will) or an administrator (appointed when there is no will) is legally responsible for this process.
HOW MUCH DOES THIS SERVICE COST?
Fixed Fee: £1,200+VAT Plus Disbursements:
This includes obtaining the grant, collecting assets and distributing them.
Breakdown of Costs:
Legal fees: £1,200.00
VAT on legal fees: £240.00
Disbursements (payable to third parties):
- Probate court fee of £300.00 + £1.50 per copy
- Bankruptcy-only Land Charges Department searches (£7 per beneficiary)
- AML checks (per beneficiary)
- £300.00-£400.00 Post in The London Gazette and a Local Newspaper – Protects against unexpected claims from unknown creditors
Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Please note, disbursements are subject to change depending on the type of case.
WHAT’S INCLUDED IN OUR FIXED FEE?
As part of our fixed fee we will:
- Provide you with a dedicated and experienced probate solicitor to work on your matter
- Identify the legally appointed executors or administrators and beneficiaries
- Accurately identify the type of Probate application you will require
- Obtain the relevant documents required to make the application
- Complete the Probate Application
- Make the application to the Probate Court on your behalf
- Obtain the Probate and securely send two copies to you
- Collect and distribute all assets in the estate
